Justice Benson Anya of Abia State High Court, sitting in Umuahia on Friday, reserved judgement in the suit by Nnamdi Kanu against the federal government of Nigeria and others.
The Judge stated this after the conclusion of sitting in the matter, adding that the date for the ruling would be communicated to the relevant parties in due course.
The suit, which was filed on August 27, 2021 is challenging the breach of Kanu’s fundamental human rights, citing the invasion of his compound in Afara Umuahia North LGA of Abia State and his forceful extradition to Nigeria, which Kanu’s legal team says, is illegal and breach of fundamental human rights.
The suit also informed the Court about how Kanu was beaten in Kenya before he was brought back to Nigeria, which Kanu said in the suit , violated his fundamental human rights.
The attorney-general of the federation, AGF, was represented during the adoption of address by Simon Enoch and Omo Osagie represented the Nigeria Police.
Amos Tori and C. Odukwe respectively, represented the Nigeria Army and the Department of State Security (DSS).
The Counsel to Kanu, Alloy Ejimakor urged the Court to okay the prayers of his client but the Counsel to the respondents in their written and oral addresses, argued that the Abia State High Court lacked the jurisdiction to entertain a case of that nature.
But Kanu’s Lawyer, Ejimakor urged the Court to ignore the arguments of the respondents’ Lawyers.
After listening to the two parties, the presiding judge, Justice Benson Anya said a date for the ruling would be communicated to relevant parties.
Justice Anya expressed satisfaction with the orderly manner the parties conducted themselves while the sittings lasted .
Speaking to the press at the Court premises in Umuahia, Kanu’s Lawyer, Alloy Ejimakor said that the case was aimed at barring the prosecution of Mazi Nnamdi Kanu as well as secure his release from detention.
